You may wish to read an article in the January 2010 issue of the Canadian Lawyer magazine, written by Kelly Harris & titled "Whither judicial discretion?" Harris touches on the same subject matter in the article, and provides a wonderful quote by former chief justice of the Alberta Court of Queen's Bench: "We've reached the stage that we could be in a new business in this country and that is the building of jails." I encourage everyone to check it out. Sounds like this was an interesting talk.
