You may wish to read an article in the January 2010 issue of the Canadian Lawyer magazine, written by Kelly Harris &amp; titled &quot;Whither judicial discretion?&quot;  Harris touches on the same subject matter in the article, and provides a wonderful quote by former chief justice of the Alberta Court of Queen&#039;s Bench: &quot;We&#039;ve reached the stage that we could be in a new business in this country and that is the building of jails.&quot;
